The problem is when i see my background check i see just the charge that was happened in 2010 i didn't see the second one. also its not showing the case is dismissed. Please help me i need a lawyer to fix every thing i have. the charges happened in SEATTLE,WA and i moved to ILLINOIS.

It is not clear what you are asking. It sounds as if you were offered some sort of deferral for your second theft charge. Under this type of agreement, you need to stay out of trouble and receive no new criminal charges, possibly for a period of two years. If you receive no new charges, and comply with all other conditions (i.e. paying fines, community service, treatment, theft awareness class, etc.), by the end of the agreed period, the charge should be dropped. The second one may not show on your background check because it is technically still pending. There is no disposition - it is waiting to see if you comply with condition for a dismissal, or do not for a likely finding of guilty. You should talk to a lawyer who can get more specifics about the situation and possibly make court appearances on your behalf while you live out-of-state.

I agree with Mr. Weiss. The charge likely does not show up in a background check because it is still pending disposition. Your best bet would be to steer clear of any criminal activity until the charge is dropped. You might want to call the court to make sure that it is aware of your change of address. There will likely be a hearing in 2014 in which the court will dismiss the charges. The court usually mails notice of this hearing to the defendant's address of record. Oftentimes, the defendant does not actually have to appear at the hearing if the defendant (or an attorney on the defendant's behalf) discusses the issue with the prosecutor beforehand. As a general comment, you should probably avoid discussing the specifics of your case on this site or any other public forum. Prosecutors may use any statements you make on a public forum against you in a later proceeding. Be careful about what you post. Good luck!
