Can the finding of marriage fraud during IR2 visa petition be ground to readjudication for the received 10 year green card?

A friend married a US citizen in 03. She was approved of an ir1. Now in 08, they went back to petition her son(citizen stepchild) for an ir2. At the interview , they requested evidence of marriage. She has a 10yr greencard, 1 joint tax return and citizen statement of relationship. The petition is returned waiting to be review. She is starting to document now. Is it too late? Her lawyer is not optimistic.
