How long does it take for the sheriff to evict in Suffolk County, NY currently?

We lost our home to foreclosure recently. We have to appear in court for the notice to petition and petition. The bank took it back to initially, i am hoping we can negotiate to stay at least for some time as i have 3 kids, 16, 13, 11 and have been looking to rent somewhere but so far, no one will rent to me. I am hoping the bank will be willing to allow us to stay until they get a buyer and we will pay rent. if not, i was curious if anyone knows how much time we would have based on whatever time the judge decides to give us in court if we do not come to an agreement before the sheriff actually shows up and would remove us? I want to make sure we are not there when that occurs.

At this point, the district court judge will most likely eventually grant the bank a judgment of eviction sometime soon. Once granted, that judgment of eviction must be delivered to the sheriff's office to conduct the eviction. Last I checked, the sheriff's office in Suffolk county was around 2-4 weeks behind on eviction orders. Notwithstanding any of the above, if you cannot find housing, you may need to file bankruptcy which will in effect "stay" any pending actions to evict you, which ultimately may afford you and extra 3-6 months to establish other living arrangements. I really wish you and your family nothing but the best of luck and pray that God provides you all that is needed.

I would agree with the other poster that you are probably looking at 2-4 weeks. You should call the loss mitigation people at the bank to see if they will offer some money in a "cash for keys" scenario, or if they will give you a set time - 2 to 3 months, i.e., to vacate. At this point you need to call the bank and work something out. They don't like to have empty houses sitting there unoccupied and they may be willing to work with you if you communicate with them.
