My First student visa is already expired on DEC 2012 and I joined in new student program in sep 2012.Right Now I am in the middle of semister(Starts from SEP 10th to DEC 20th 2013).and New semister Starts from Jan 2nd 2014.. I want to apply for H4 so that I can discontinue from the new student program. what would be the best time to apply for H4 and How I can apply?Do I have to apply through attorney?can I apply it on my own and how long it will take?

You can apply right away, and you don't need a lawyer. As soon as you apply, you can stop attending classes if you wish.

You can request a change of status on form I539 from F1 to H4 right now. Once the receipt is issued you can stop studying. You can file on your own, its up to you if you would feel better doing it through a lawyer or if there is an issue in your immigration history you want to discuss. You can find out about the process on USCIS.gov.
