Can I charge someone with libel and defamation if they have posted on Facebook that i am a date rapist.

My friend's mother has posted a status on Facebook (Petty i know) and in this status she made a comment that i have date raped many girls, which in fact is not true and i have many people who can testify to that fact, this may not seem like a big deal but i live in a small town and news travels fast, this could impact my social life and how employers see me as well. Calling me a rapist is a very heavy accusation and I cannot be seen as something I am not.

It is probably a defamation case where damages are presumed and publishing it on Facebook is clear evidence that the statements were published. This is really a libel claim because its written statements. Take pictures of the statement on Facebook so you can preserve the statement. Call a local litigation attorney too and good luck with it.

This is a defamation case, what is known as libel per se, a written statement falsely stating you have committed a crime. As previously answered, take a screen shot or photo of the screen with the libelous post. You should consult with an attorney in your location with experience in defamation and privacy law. Consider demanding a written retraction of the statement, to be posted on Facebook, and a letter of retraction that you should keep with you for future reference. You should also report the offending post to FB, although it is likely they will not do anything about it unless you obtain a court order requiring removal or retraction of the post.

Yes. The appropriate charge is libel. The elements of libel include: (1) a false and defamatory statement concerning another; (2) an unprivileged publication to a third party; (3) fault on the part of the publisher; and (4) either actionability of the statement irrespective of special harm or the existence of special harm caused by the publication. A communication is defamatory if it tends to harm the reputation of another as to lower him in the estimation of the community or to deter third persons from associating or dealing with him.
