Can a babysitter refuse to let me pick up child for a doctor appointment if I have joint physical and legal custody?

I have joint physical and legal custody for 4-year-old child. I went to babysitter's house (other parent's friend) and told her I was there to pick her up for doctor appointment. She told me no, get out, get off her property and then proceeded to yell to her husband to call the police. I then called the dad and was told she is supposed to receive notice about appointments. Is this fair?

It will depend on exactly what the orders and agreements you have in place say. You need to sit down with an attorney and have these documents reviewed.

Look at your Custody Order or Agreement and pay close attention to whether or not there is a provision that grants either you or the other parent a "right of first refusal" to care for the child if the other parent in unavailable. Also closely review all of the language detailing visitation. My colleague is correct- you really should consult with an experienced family law attorney.
