I have a question about supervised visitation

4 views 3 answers
The court gave me supervised visitation with my son. The order states that the monitor is to be someone mutually agreed upon by both parents or a professional monitor, which I would be responsible for paying. My ex refuses to agree upon a monitor even though I offered to let him choose who, when and where, so I can see my son. He is forcing me to pay a professional. I have looked into these services and cannot afford the outrageous fees. So I can't see my son because I'm at a financial disadvantage. What can I do? I want to see my son.

Unfortunately, it sounds like your only choice is to go back to Court, and explain to the Judge that the child's other parent refuses even reasonable offers for a "mutually acceptable" monitor, and also refuses to make his/her own choice. You can ask for the following relief, in the alternative: 1) that the court approve of your choice of a non-professional monitor; and/or 2) that the court make the child's other parent pay for the monitor because he/she will not agree to anyone who is non-professional.

Has your ex recommended anyone as a monitor; or is he/she simply rejecting all of your choices? if she is refusing to cooperate with choosing a monitor it might be time to go back to court and get a clarification of your order regarding consequences of either party's failure to cooperate with selecting a monitor.

I agree with counsel. If you are unable to reach an agreement with your ex, you need to go back to court for further clarification. Additionally, I would not wait very long as seeing your son is a priority and the longer you wait to address this issue could be harmful to him and yourself.
