Passport details for I 140 filling

2 views 2 answers
Currently not in US (completed 6 yrs of h1b). Perm approved and about to file I 140. But, my current passport has been canceled and waiting for new passport to be issued. Can I apply I 140 with canceled passport (which has all details of my 6 yrs of entry exit in US) or need to wait for new one and apply with both details? Is passport details necessary (since I am no more in US) to file I 140 ?

Current passport details are not necessary for an I-140 beneficiary not present in the US at the time of filing. Remember that the I-140 is not an individual filing by you at all - it is a petition by the US employer on your behalf.
