VA gift laws, if a friend bought me a car, can he ask for it back

A friend had bought me a car. I received it with no title. I found out he was a convicted child molester and quit talking to him. He showed up with cops to get it. I had been driving it for 3 weeks, had insurance on it.... was dependent on it. My mother was going to help my buying me a car but I turned her down when he guaranteed the car. He took it back over jealousy and me not talking to him. I have plenty of emails for mths with comments of "your car" and such, noting it is my car. Even until I had him arrested for stalking, he was still offering to give me back the car, if we could be friends. I know I should live it alone and be thankful he is leaving me alone, but I would have accepted my mothers help and had a car. I gave him 1000 when I had my tax check towards the car but with no receipt. I have proof of all of this with pictures and emails. Would I be stupid to try to take him to small claims court for the car?

Because does not yet have a lawyer directory in your state, you may not receive a lawyer response. My goal is to give you some preliminary information and guidance regarding your legal situation while you wait for an attorney in your area to respond. http://www.attorneyqna.com/attorneys/98101-wa-avvo-moderator-1769851/aboutme.html You could try small claims, but it likely will not turn out well as someone's intention to give a gift is not typically an enforceable contract. Plus, as you note, this isn't someone you want further contact with.
