The filing fee paid to the court in Clark County is $289. You can file while you are physically outside of the state, but that really doesn't make much sense and invites glitches. There is a residency requirement, and you must file an affidavit of resident witness along with the rest of your papers. Use the self help center to get the right forms, and then file them in person in case there is anything that needs fixed. Even with "no property" you should consider using an attorney, or at least consulting with one. There is always more to the situation, and very few matters are truly "simple."

As Ms. Whitbeck stated, the filing fee for a complaint is $289 in Clark County. You can certainly file an annulment and/or divorce without an attorney, but you should really consult one before you file to determine whether you are eligible for an annulment or a divorce. Annulments are very difficult to obtain in Nevada and it is better to have an attorney that is familiar with the process who can advise you whether your annulment has a chance of being successful. Also, as Ms. Whitbeck stated, if you are considering a divorce, you need to have lived in Nevada at least 6 weeks PRIOR to your filing. If you are unable to prove your residency, the Court will not take jurisdiction of your case. If you and the other party are in agreement, and you meet the residency requirement, you might want to consider a joint petition for divorce - however, this option is not available for annulments in Clark County. The filing fee for a joint petition divorce is cheaper than filing a complaint and answer. Even if you do not hire an attorney, you should consult with one.

It sounds like you and your spouse are not Nevada residents. In this case, the Nevada courts do not have jurisdiction over you to divorce you. To be bale to file a divorce in Nevada you have to be a bona fide Nevada resident AND lived here for 6 weeks prior to the filing of the divorce AND to have the intent of making Nevada your state of residence for the unforeseeable future. Filing for annulment has different jurisdictional requirements, but you have to have your case examined by an attorney to see if you meet the requirements for an annulment.

In addition to the below answers, a divorce requires residency for 6 weeks preceding the filing of a Complaint. So the reason for your being out of state at the time of filing could come into play if your residency is questions. An annulment does not require residency if the marriage occurred in Nevada. Always best to consult with an attorney who specializes in Family Law.
