K3/K4 Visa?

Business 2 views 3 answers
Ok, now I would like to know if I file form I-130 for my spouse and once it's approved I file a K3 Visa for Nonimmigrant. Would I be able than to file for a K4 Visa for my stepsons without paying additional fees for them. Although I know it is more expensive due to the fact that we would need to pay for the work permit and adjustment of status once he enters the country, but since I'm going to do this process anyways since I want my husbands process to be faster. Would all this accelerate the process of entering the U.S ?

If they otherwise qualify you do not need to file a separate I-130 for stepsons. However, I've had cases where K-4s were unable to later adjust and aged out, because a step parent failed to file a separate I-130 on their behalf. I would strongly advise you to file separate I-130/I-129 applications for each one of them if you want to go that route. The savings is not worth the risk of not being able later adjust.

K3 is no longer processed by the posts. When it is approved, the posts process it as an immigrant visa. Hence, no sense to even deal with k3. I-130 is the way to go.
