In New York state, are legal fees incurred as a result of the trustee's negligence chargeable to the trust? Thanks

The remedy is an action for an accounting. If the court finds that the trustee failed to act prudently, the truste may be personally liable. The language of the trust instrument or the will creating the trust is very important. You should consult with an attorney who is expert in estate and trust litigation.

Yeah, the trust language determines whether the trust pays for trustee negligence, and may have conditions--e.g. "only if the trustee is not a professional fiduciary/in the business of being a trustee," "only for willful misconduct," etc. Consult a trusts attorney for their take on the language in question.

All depends on the terms of the trust as to leniency as a trust grantor could have specifically allowed form errors in judgment (done in good faith) versus willful acts or omissions that a prudent man standard could not find to be anything less than culpable. In addition, the alleged "negligence" is a legal conclusion that can only be ascertained by a detailed review of the specific facts and circumstances encountered by the trustee and the thought process and choices made in relation thereto. In addition, NY has a distinction between ordinary negligence and gross negligence and the distinction between the two could require a legal analysis by the court as to all issues on the table.

The answer will depend upon whether the trust was written in such a way to allow it, whether the actions of the trustee warrant such action, and whether the court will allow it in light of all the facts. You will not get a better answer until you consult with an estates and trusts attorney, and give them a chance to look at the trust instrument and discuss the facts with you. Best of luck.
