Because you are 17, you are an adult in the Massachusetts criminal system and because the other person is 16, he is a juvenile. You certainly could get charged and arrested for fighting him, but an equally significant issue is that you could get suspended or expelled from school for fighting. It sounds like the problem lies with the 16 year old student with the big mouth. Please do not fight with him as you could be charged with an assault and battery in criminal court. Certain assaults and batteries are considered more serious crimes and they are labeled felonies. If you are charged with a felony, your school may suspend you indefinitely. If you plead guilty or are convicted or otherwise admit to the facts of a felony, you might be expelled from school. All of this could happen to you even if you feel you are justified in taking up this boy's challenge. It simply is not worth risking acquiring a criminal record. Even if you are not charged with a crime, the school can impose its own discipline for fighting. The better course would be to inform your gudiance counselor of this harassment, to at least put the school on notice in case this boy attacks you first. If either you or the boy has special needs, the situation can become more complex. You or your parents should contact a lawyer.

You should not fight the other student. If he continues to run his mouth, you should talk to the school principal or your parents. It is better to have adults intervene. If you do fight, you could be arrested for assault and battery, or if any weapons were involved (included some types of shoes) you could be charged with assault and battery with a dangerous weapon. If you have any questions, please do not hesitate to contact my office.
