My ex husband has a total of 10 felonies all pertaining to theft/burglary. he was recently charged with burglary of an unoccupied dwelling, unarmed which is a second degree felony. He is taking this to trial, but there are witnesses against him. If he loses, how much time is he looking at? Prior to this charge, he was arrested for possession of a credit card making machines, with fraudulent credit cards, drug paraphernalia, and narcotics, in which he was sentenced to 1129...this new charge with the dwelling was issued while he was in jail for the other charges, although both are in different counties. He is also wanted in Pennsylvania for skipping probation but they will not extradite him. He is a habitual felony offender and does not know any other way to live.
If the jury convicts him, his prison score at the bottom will be whatever he scores on the FL points system. Habitual means that penalties can be increased (double the max, as in 15 years on a 2nd degree becomes 30 years) , so based on that a judge post-trial can sentence him anywhere from the bottom to 30 years, assuming that's the only charge he is going to trial on. Good luck to you both.
Are you kidding?
How's about you forget how long he's facing (lets just call it "pretty much forever") and consider yourself lucky that he's your ex.
From what you've proffered, between FL & PA you will not see him on the outside for a long time, if ever again.
You know the answer, why even count? He is facing so many years that at this point, why even speculate? He is not a lost cause however, a good criminal defense attorney can probably negotiate a global plea bargain for him. However, don't expect him out anytime soon.
