Father under-reporting income by $2,500 a month on his financial affidavit, motion for rehearing of final judgement for CS.

I am a pro se litigant in a child custody modification. The order was signed on 2/3 and I am preparing a motion for a rehearing for the CS order. The date of the original mod was filed in March of 2012, so the judge has ordered retroactive child support from that date. My ex gets a base salary, plus a yearly bonus. He says he doesn't know what his bonus will be each year, so he has been averaging it over three years divided by 12 months and adding it to his monthly gross. I just discovered that he reported earning $168,062 in gross income in '12, which equals $14,005 a month gross. He only reported $12,142 a month gross on his financial affidavit. He is also not reporting rental income that he is paid in cash. I feel sick. Am I missing something?

Are you missing something? Probably. I don't mean to be harsh but you're going to need to visit face-to-face with a family law attorney who can look over all the documents and give you specific advice. I don't know your financial situation but if you personally cannot afford an attorney, you should still consider hiring an attorney and it might be possible to seek attorney fees from your ex. It certainly looks like he can afford it.
I agree with the other attorneys, what you are missing is a good family law attorney. You really should consider consulting with one. Some attorneys will accept a payment plan and of course it does appear that your ex could be hit up for attorney fees as well. Go see an attorney near you soon because this has got to be overwhelming for you to try and deal with on your own. Good luck.
Sincerely,
B. Elaine Jones, Esq.
