If the case is upgraded to a felony, the state can request that your bond be increased. If that happens, the judge can order you held until the bond is deposited. You should need to retain an attorney to help you with this case.

If your case is upgraded from a misemeanor DUI to a Felony DUI, it is likely that the prosecutor will ask that a new bond be set on the upgraded charge. Some Judges will not disturb the original bond amount and either allow the previous bond to stand or issue an I-Bond. Other Judges will increase bond, so it is wise to bring some acceptable method of payment to Court so that in the event bond is increased there is a way to be released while your case is pending. If you are unable to post the bond set by the Judge, you will remain in custody during the pendency of the case up till (and perhaps beyond) its disposition. I recommend retaining a lawyer to guide you through this process, especially since the case is becoming much more serious with the felony upgrade.

They have to have a legal basis to upgrade.
