Having a hard time with a constant complaining tenant. I no longer know what to do?

I have a tenant who constantly complaints about the tenant(s) upstairs. He keeps calling the cops on the upstairs tenant and keeps banging on the ceiling. I have a new tenant upstairs and the complaining tenant is already bothering the new tenant. I no longer know what to do with this situation since the housing rights doesn't get involved in this matter. Every time I have a tenant upstairs or on the sides of this complaining tenant, he keeps bothering them and saying that they are loud. The complaining tenant has written very nasty letters regarding some tenants and their children. The complaining tenant is also behind one month of rent. What should I do? I know I will be going to court if I post him either a 3 Day Notice or a 60 Day Notice to Vacate. I need more information pl.

Unless they're in breach of contract then you can't do a 3 day notice to pay or quit. You could give them 60 days notice if they're harassing other tenants although it will not be an easy battle if they don't move.

If you are worried about dealing with the complaining tenant, hire a lawyer to serve the 3 day notice to pay or quit and then evict, if the rent is not paid in full. Do not accept partial payments.

If the tenant has not paid the rent, your recourse would be to serve a 3 Day Notice to Pay Rent or Quit and proceed with the unlawful detainer. If you are in a non-rent control jurisdiction, you could also serve a 60 Day Notice if the tenant is current on the rent. Contact a local landlord-tenant attorney in your area to get the process started.
