What recourse do I have If an insurance company surcharges my husband for a one-vehicle weather related accident when it was me?

I struck a guardrail after hitting a patch of ice at the bottom of a hill on my street. Minor damage to vehicle. Police were notified and report made out. After my deductible, it amounted to $250 in damages to my vehicle. I received word from ins. co. that my husband was being surcharged (Massachusetts) for a "major" accident. He wasn't even in the car. I plan to appeal due to the weather conditions and felt I was driving as a "reasonable" person would under the weather conditions. Any suggestions to help me with my case especially since they have the wrong person surcharged? If their documentation is incorrect, does that help my case?

Do you share the same insurance? When is your hearing? What is the reasoning they used for the surcharge.

Get an attorney help you with this. The cost should not be very high, and might be less than the insurance surcharge. Ultimately, you need to make a business decision looking at the cost of the lawyer and the cost of the insurance surcharge.

I agree with both counsel, talk to your insurance broker as well.
