Do I have a case for personal injury for emotional distress?
Anonymous5 views6 answers
I was let go recently told I didn't fit the culture. However, I feel like it is due to a few complaints I raised regarding hostile work environment regarding an employee who has had several complaints and who has had several employees resign because of the bullying behavior. I sought treatment and are still in treatment for anxiety and depression regarding the long standing emotional stress I endured with this employee. I have countless emails as documentation. The executives stood back and watch for most of the show until it became apparent that this person couldn't continue to be in the office so they sent her home to work from home instead of firing her for all the complaints.
I was a model employee, everyone loved me. Telling me I didn't fit the culture was a crook of BS!
Your only claim, and I am doubtful of that, would be through an employment attorney. I assume you were not with a contract or union. Practice area added.
It depends; however, in Florida--a right to work state--an employer can fire you for any nondiscriminatory reason,. so you are not likely to get back your job.
No one on can give you a definitive answer about an intentional infliction of emotional distress claim. I can say that this is not a case most of us would take on contingency because such claims are usually losers.

You do not have any claim for personal injury or for emotional distress. These types of claims are not viable in Florida without either a physical impact to your person, or severe emotional consequences.
You might have a claim in the employment law feel, but I doubt it. Florida is an "anti-will" employment state and you can quit or be discharged for any reason or for no reason at all without any consequences to you or to your employer. The exceptions are the exceptions codified under federal law such as race, religion etc. But they certainly do not include not fitting into the corporate culture.
This issue is not in the realm of personal injuries but more of a work place employer/employee issue. you should seek advise from a lawyer in the employment litigation field.
