Corrective Lenses fine instead of speeding ticket?
Anonymous3 views3 answers
Hello, I recently got pulled over for speeding. This is my first ticket. I'm a new driver, and am still currently insured through my parents, however that will be switching soon. The officer who pulled me over said that instead of paying the speeding ticket, and receiving points off my license, I could instead pay a corrective lenses fee. I'm not sure I quiet understand why, I do have the restriction on my license, however I was very clearly wearing my glasses at the time. I'm not sure if he's just trying to be helpful, or if I'm falling into a sneaky little trap. That's why I've come here. I fully intend to pay the ticket/or fee as my court date is 6 weeks away and I really don't want this looming over me. I just want to know what exactly I'd be pleading guilty to for paying a lenses fine
You may qualify for certain programs where you do not have to plead guilty to anything depending on the number of points the ticket is for. I think talking to a local attorney in your area may be of some benefit to you.
The burden of proof is on the officer to show, beyond a reasonable doubt, that you were not wearing corrective lenses as required on your license. Frankly, I've never heard of anyone receiving such a ticket before. This strikes me as so ridiculous that I would consider a jury trial. Any reasonable prosecutor would likely nolle pros the ticket (make it go away as though it were never written). I can't imagine how you could be falling into a trap. It seems more like you fell into a pile of bull****. I would never advise a client to plead guilty to something they are no guilty of. Best of luck.
My understanding of what you are asking is that the police officer is stating that he will reduce the speeding violation to a ticket for not wearing your prescription glasses as required if you choose to not fight the ticket. It seems like this could be a good deal instead of a speeding violation. To be sure contact an attorney who handles traffic tickets in your area and seek a free consultation. Paying the fine is the same as pleading guilty and you want to make sure that you get this matter cleared up as best as possible to keep the insurance rates low.
