Can a Employer threatened to let you go, if you take your Paid time off?

My Boss suggested to me today that I should carry over 5 days of Paid time Off (which is what you are allowed to carry over in a year)and the rest of my time, I should not use and just lose it. Not to take vacation at all. He insinuated that if I don't do so, that in the next three to six months when the Company is evaluating the positions of each Department that because I chose not to be a team player they may have to let me go. I almost felt like he was threatening me. Can an employer legally do this?

If you are not a member of a uniion, NJ is an employment at will state which means you can leave at any time or you can be fired at any time, unless the reason is one of discrimination. One way of looking at this is that the boss is trying to help you keep your job. Another way of looking at it is the practice is a way of avoiding paying your wages which is a violation of the law and can be reported to wages and hours. New Jersey Department of Labor. On my profile there are several legal guides. I recommend reviewing the following which may be helpful to you: Hiring a lawyer; Is it Legal? Is it Illegal?...Understanding the different court systems; Introduction to Legal terms used in litigation; Limitations on a Lawyer’s License: What a Lawyer Can and Cannot Do……………………………..………………………….. His response here is not legal advice and does not create an attorney/ client relationship. The response is in the form of legal education and is intended to provide general information about the matter in question. Many times the questioner may leave out details which would make the reply unsuitable. Mr. Sarno strongly advises the questioner to confer with an attorney in their own state to acquire more information about this issue.
