Does a lease override the Arizona tenant law?

My lease is about to end and I am going into a month to month situation until I find a house to purchase. My lease says that in a month to month situation you must give 60-days notice to vacate. The Arizona tenant law has a section that says the tenant needs to give a 10-days notice. When mentioned to my landlord, she said the AZ law is a "minimum" requirement and that a landlord can designate any amount of time they want in their lease. Is this true? Or do they have to follow the AZ tenant law that states a 10-day notice is given?

The lease cannot counteract the provisions of the Act. But the 10 day section you are looking at does not apply here. Best to have a lawyer look at the language of your lease. There are a number of possibilities.

Your landlord is correct that she can designate the notice period required if you want to rent from her on a month-to-month basis. If you do not like the notice period, you are free to lease month-to-month elsewhere.
