Generally speaking the beneficiary designation will control over and above the will. In some jurisdictions there is case law indicating a will made after the beneficiary designation COULD effect things, but very rare. See a lawyer to learn about the law in your particular jurisdiction (ND?)>
Whomever is named as beneficiary on the annuity will automatically become the owner on the death of the owner. The annuity will not pass through a Last Will or Trust. If you want to do something exotic or complication I would strongly suggest you speak with a local attorney.
Good Luck!
It is difficult to answer your question with the information that you have provided. I would strongly recommend that you have the situation reviewed by an attorney. It is unclear if you are trying to do some type of life planning or whether this has already happened and you are trying to determine who is the proper beneficiary. In either case I think you need to consult an attorney. It will be impossible to get a specific answer to your question unless the attorney knows all the facts and circumstances.
