How to enforce an article 78 order?

Business 2 views 3 answers
I submitted a petition for an article 78 hearing to review documents in the town of Oyster Bay and received an order from the judge stating that the town has until May 19th to arrange for a date to review the documents. They were also ordered to provide me with a copy of a complaint someone made on my property. They are ignoring me. How can I get this order enforced?

I don't think you can do anything because their time to comply has not expired. If they have said they will never comply then you can make a motion to hold them in contempt of court.

You can and should document in writing your repeated requests to obtain the documents and also put the town on notice that if they fail to comply with the court's order you will move to hold them in contempt. But you cannot file a motion until after the deadline passes.
