Getting back my gets after adoption

Child Custody 7 views 3 answers
Hi my name is Kacie and I went through a adoption with my father and step mother. I was going through a divorce and I had nothing, never had a job or anything. So they decided to help me until I got back on my feet. Well I was so emotional through the divorce and having my kids live somewhere else and not with me since I was a stay at home mom since they were born. I went through so much with my kids. I was always with them until I wasn't anymore. Then my dad and step mom wanted to adopt them from me since my dad told me I would never get them back and I listened to him because I was already a mess. Well I signed the papers and the lawyer gave me a copy and told me I had 10 days to changed my mind well my step mom took the papers from me and told me if I needed them she would give them to me so my mom wouldn't see them. Well I told my dad I needed the papers and he never gave them to me. What I am asking if this would help me get my kids back?

Probably not if it's been more than 10 days. Not sure what paperwork you gave them, but likely just the adoption documents; there's noting really magical about having or not having the documents, the issue is raising an objection timely.

If ten (10) days have passed it probably will not help. The papers were not required for you to rescind the termination of your parental rights. As such, the withholding of those papers will not help in undoing the adoption. If you are still within the ten (10) day period you should immediately contact the lawyer and tell him that you are rescinding your consent. This should be done in writing in addition to verbally. The deadline is a strict one, so do not delay. Good Luck!

You should absolutely contact the attorney who handled the adoption if you are still within the 10 day time period and wish to rescind the termination of your parental rights. There are other ways to make certain your children are taken care of besides adoption. for instance, it is possible to give temporary guardianship of your children to the same family members. A temporary guardianship does not extinguish your parental rights but you would still have obligations to your children since your rights would be intact. A temporary guardianship would allow you to get back on your feet, stay in contact with your children, and later petition the court for a termination of the guardianship once you were in a position to care for your children. A qualified family law attorney would be your best bet. Good luck!
