Do I need a lawyer who deals with debt collection?

How can I put an end to my brother's car payment bill from coming to my house EVERY MONTH? He asked my father to co-sign a car loan for him. My father agreed but has since passed away. I live in the house that my father used to live in. I own the house. My brother does not live in my house. I asked the car company to stop sending the bills here. It is annoying. Now I get past due bills and collection agencies call my house. The car company said the request has to come from my brother. I told my brother about the situation, he knows, but he said he doesn't want to waste his time calling the car company. Yes, that was his response. Don't I have a right not to receive another person's bills? Please help. Thanks.

Before an answer can be given, you need to determine if your late father has an estate that has assets and could pay all or some of the debt. If not, then send a letter to the lender, I suggest sending it Priority Mail with delivery confirmation, telling them that your father is deceased leaving no estate to pay the claim and that the other obligor does not live with you and politely telling them not to send any more communications to your house or phone. You could also put together a letter to them for your brother to sign. If you stick the letter under his nose and pay the postage he might sign it. The others are right that it is illegal to contact a person not obligated but this is a practical way that has always worked in the past.

I Agree That You Should Send A Cease And Desist Letter. The FDCPA does Not Apply As It AppearsThat The Bills Are Coming From The Original Creditor But State Law Applies. I Suggest Sending A Copy Of Your fathers Death Certificate Along With The Cease And Desist Letter.
