Can my ex wife claim a weekend on my extended summer possession which is all of July? Under Texas standard possession orders

after posting that i have paid for a vacation for the kids and I during the first two weeks of my July possession, my ex wife sent a letter stating she has the right to take a weekend away from me, and claimed the very weekend we will be on vacation.

I agree with the prior posts (talk to an attorney and let him/her review your current order). Yes, under standard possession order the custodial parent usually has the right to a weekend (or two depending on the terms of the order) during your extended period of time. The terms of your order are most relevant. It may say something different from the "standard possession order" set forth in the Texas Family Code. In addition, your order may specify that she gets the weekend provided that she pick up and return the children from you (not your residence). If this is the case and assuming you want to still go on the vacation, does she plan to pick up and return the children to you at your vacation spot. Good Luck.

the answer lies in your divorce decree or other custody order. Typically, yes, she is entitled to one or two weekends during your extended possession. That is why there are deadlines set out in the order. That way, people can plan vacations. It sounds like you may have jumped the gun. See if you can work something out with her.

I know this is not what you want to hear....but yes she can. You should try to negotiate with her. Good luck!
