Complex provides and manages mailboxes that were broken into and with surveillance cameras keeping track of these areas. Who is responsible for losses in this situation? Complex does not want to fix mailboxes. Complex does not want to pay for costs of stolen mail and stolen packages. Complex does not want to provide their paperwork for their insurance company even with police reports. Besides the problems with the stolen mail and packages, there is a huge risk for identity theft, and other crimes. Some people have their medicine and other prescribed packages mailed to their homes. What recourse is available to the residents of the complex? Who can take reports for these mail thefts? How can residents get complex's insurance company to cover these losses due to mail theft?

Generally such complaints are made to the US Post Office. Absent some federal regulation related to the operation and maintenance of apartment post boxes, taking the mail is a Federal crime, and property owners are not usually responsible for the criminal acts of others. If you get meds or important documents in the mail, you may be wise to simply get a PO Box at the local post office to minimize such things.

It would be very difficult to hold the apartment complex liable for the intentional acts of another, especially, on a property crime. Also, it is difficult, with any degree of certainty to determine what was in the mail and costs involved. Otherwise, you are going to be suing the complex every time the crime happens - not a very effective game plan. The best and most practical advise is to get a local post office box that completely takes the apartment complex out of the equation. Best success! Richard A. Alexander, Esq.
