Will my employer find out about my misdemeanor arrest?
Anonymous7 views3 answers
I have been charged with a misdemeanor in Georgia. I work for a state university, so it is a state government job. Will my employer find out about my arrest by any means besides myself? There will not be any background check or anything going on, but since it is inside the government, I wonder if the system will alert them anyway.
If not for the arrest, then same question for the charge, if that should happen.

Unless they use a service that does background checks on individuals, I doubt it. However, if you go to court and are put on probation, there is the possibility that probation may contact your employer. Also, the records are open to the public, and could get in the newspaper if they do crime blotters or some such in Athens. Also, needed to be absent to go to court can cause raise employer concerns and may result in their finding out about the arrest. There is no internal system that notifies state employers about arrests. However, unless you have a requirement to notify your employer about your arrest in your contract or as part of employee rules and regulations, you probably don't have to say anything. In any case, you have to weigh the effect of your telling them versus their finding out on their own. I don't know your relationship with your employer or your job, so it would be as discussion I would have with my lawyer before I did anything. I would hire a lawyer as soon as possible to try and avoid any problems with work and resolve your case as quickly as possible.

I have dealt with the solicitor general in Athens on many occasions. If you have no prior legal issues, and it appears that you are taking your charges seriously, which means hiring an attorney, you should be able to make this charge go away without any real issues. However, if the charge is a dui, that is a different story.
