What are the qualifications for an indigent spouse in a divorce?

I have not work in some time. My psychologist gave me a letter stating I can't work after my horse was beaten and or hurt too much. I have cancer and other medical issues that keep me from sleeping. What can I do for attorney fees during my divorce? My husabnd has $150.000 in the savings but he has filed all the countersuit faults in a divorce that someone could file. I'm having trouble proving I should get funds. My attorney is not asking because my spouse's attorney is objecting. Don't I have a right by law to funds for a fair and just trial with attorney fees? Even if I am at fault for something. I don't know the law but I'm learning. Thanks.

Unfortunately, in family court, there is no constitutional right for you to receive funding from the state or federal government. Your attorney can ask for attorney's fees from your husband at the end of the trial or during temporary orders, but only the Judge can grant you that. There is no law that states that your husband must pay for the divorce, or any law pertaining to funds being given to you to ensure that you have a fair trial. You may want to consider looking into your local Legal Aid Office and see if they can help you. You would have to leave your current attorney first, but Legal Aid provides free legal representation to those who qualify.
