Can HOA put lien on property for Violation fines?

I own a condo in Los Angeles. I have had problems with neighbor directly below me for years. Now she has started telling the board that I am doing short term renting. HOA now has assessed 5 violation fines. It seems every time she hears more footsteps then mine, she tells the board I'm renting to people and they add another violation. Each fine doubles: $50.00, $100.00, $200.00. It's up to $800.00 for one fine. I am contesting these arbitrary and unfounded violation fines. Requested a hearing and they said they mailed me a hearing date and I missed it. All of my dues are current. I refuse to pay unfounded fines. Can I take them to small claims court to get them removed or do I have to go to Superior court? Currently the board is in violation with only 2 members on board.

Get an attorney. Yes, they can almost certainly place a lien on your property. On these facts you have several good arguments. If the Board only has two members, they are probably flying by the seat of their pants and a good attorney should be able to put this nonsense to an end. That said, you'd be well served by abiding by the covenants, including the rental rules, even if they seem ridiculous to you.

Yes, they can put a lien on your property for not paying assessments.
