Should I hire an attorney? What kind?

My fiancé got pulled over at 4:30am driving my car as reported by the officer: without a license, failing to possess registration (he couldn't find it in the car, but it was there), and disregarding a stop sign. He doesn't understand much English and was confused. He provided a birth certificate as the only ID he has. He is undocumented, but we are getting married soon. He has a court date in 2 weeks. What can we do? Will the court even mention the latter?

Your fiancé Should contact a traffic/motor vehicle violation attorney or, if they qualify, a public defender. They should also contact a immigration attorney to assess any and all deportation/immigration consequences, if any, for these charges. It sounds like your fiancé is facing charges that could result in a drivers license suspension, motor vehicle points, high fines and potentially jail (although unlikely if it's a first offense). An attorney will review your fiancé's case in detail and look for any and all potential defenses and otherwise maximize your fiancé's chances of a favorable outcome. You can many qualified attorneys on . Some even have the capacity and qualifications to talk to your fiancé about not only the consequences of theses charges, but also their immigration consequences, if any, as well. Good luck

Irvington is a tough court without an attorney but reasonable with one. This can result in fines and suspension maybe even less. His status is a problem because he can be picked up anytime anywhere. I have not seen ICE in the Irvington court but then again they do not wear badges. I have not seen Irvington call ICE. He only need to admit that he never had a license but there are ways around that if the charge is changed. Call an experienced criminal defense attorney.

Your fiancé is facing fines, suspension, and maybe jail on the traffic violations. The fact that he is undocumented is not an issue for Municipal Court, but ICE could detain him if they find him. You should call an experienced criminal defense attorney to represent your fiancé.
