Visa Stamping after Change of Employer in H1B
Anonymous2 views2 answers
I'm currently working for Company A. My Passport has a H1B Visa Stamp which shows Company A's name on it. The visa is valid tip 2016 Oct. Company B is going to sponsor my H1B and I'm joining them after 1 month. As I'm a frequent International traveller - do I need to go for visa stamping again for Company B? Will it be a problem to enter USA with Company A Visa and Company B's petition ? please suggest

No, you will not need to get a new visa stamp specific to Company B. You will be admitted back into the US on your still valid H visa issued for company A, but must have the USCIS approval notice for B's petition, as well as proof that you're already working for B, such as three of the latest pay stubs, as well as a letter from employer B confirming your employment and job duties there, specifically addressed to CBP at the airport you'll be landing yet.
If your visa stamp is valid until 2016, you need not apply for a new visa stamp and should be able to re-enter the U.S. in H-1B status with the original I-797 approval notice for your H-1B with Company B. You should discuss this with the attorney who files the H-1B petition for Company B on your behalf.
