We realize he has lost his green-card but now he would like to come to the US for a holiday and to visit me. How can he do this and be sure he is not detained at port of entry and sent home before being able to visit me or vacationing? Sharon

He needs to go to the US Consul in Australia and: 1. Turn in the greencard ... even if it is expired. 2. Apply for a tourist visa.

He should give his abandoned green card to the US consulate. He needs to apply for a tourist visa showing substantial ties to Australia.

He must apply for a tourist visa at US consulate, which will first terminate his residency once they know that he has abandoned it, and if he is granted the visa then he can come in. although technically he can use his resident card to come in now but his card will be taken from him, and he will be given an I-94 to remain here for up to one year, and then he will be placed in removal proceedings to see a judge so that his resident status can be terminated by the judge rather than by the Consular office.
