Does the landlord have the right to deduct money from our deposit for things not listed in the contract ?

My husband and I leased a home and occupied it for almost 3 years. The homeowner wanted to put it on the market and gave us 45 days to vacate. She asked if we would allow potential buyers to view the home in exchange for half the rent for that month which would be $600. We agreed, however, no one came to view it. Now that we've moved out she is charging us for things that are not in the contract such as having her trees cut as well as for things that she gave us permission to do such as paint. Total deductions were $590. The realtor who managed the property is a witness to the above agreements. According to the Realtor, the homeowner is unhappy that she only received half the rent so I believe she is making her deductions to compensate for it.

If you signed a Texas Association of Realtors lease, there is a provision that specifically addresses yard maintenance and who will be responsible for it. The term "yard" is defined to include trees. As for the paint, absent damage beyond normal wear and tear -- like if you painted a tie-dye design in the living room -- you probably shouldn't be charged for new paint. Have an attorney review your lease and talk to you about the specific deductions.
