How to stop harassment of relatives by a debt collector

Wage Garnishment 4 views 3 answers
My mom, who resided in Pennsylvania, received a letter from a bank stating that they got Garnishment - NY restriction notice from a debt collector about and they are holding an account and safe deposit box. She does not have an account with that bank but she does have safe deposit box ( I am assigned to it as death beneficiary). Question: can they do that? If yes what can they do? What can I do to stop harassment? I checked the court records based on the index number and the company got a judgment against me in 2009 without notifying me of the case. Looking at the free NY court records they had me listed at address that I don't live. Is what they did legal?

You don't provide enough coherent information. You should bring all documents relating to this matter and consult with a consumer/debt collection attorney in your area.

Hi, this is an interesting situation, the pay on death account is in your mother's name but it is created for your benefit. See an attorney, however, If you were not served with court documents, the court should vacate the judgment and restraints on the deposit box and restore the case to calendar, since your due process rights were not satisfied, lack of notice of the case in court. Send a letter to: Bank , and the Creditor's attorney and explain to them that the account they are holding is a pay on death account that does not belong to you but your mother, your interest will mature upon, G-D forbid, your mother's death, and request a release from restraints. Good luck

Your mother should be able to get the attorney to release the lien on her box, I would suggest she see an attorney familiar with the FDCPA and PA debt collection laws
