Is it legal in Texas to speed in the passing lane to pass a car that is moving slow in front of you? I was speeding in the passing lane to pass two slower vehicles that were in the right lane. The speed limit was 55 and I drove 69 to pass both cars before being able to pass and shift into the right lane.

Before reading counsel's response, I had the same thought: Speeding is speeding. If you were driving 69mph, you were exceeding the speed limit of 55. I don't see a winning defense here.
