Can a biological parent be charged with child abandonment/neglect when the child is 18 years old?

My niece's father sent her to LA via bus on 12/19/09. He told her that she could no longer live in his home. She has NOT completed high school; she is a senior - 1 semester remaining before graduation in May 2010. The father DID NOT contact any of the maternal relatives regarding his decision to return her to LA. What if we (maternal family) were not available this weekend? She would have been abandoned. As to date, he HAS NOT contacted the maternal family. The maternal grandparents called his home on 12/20/09 to check on the grandchildren. No answer as usual. We are seeking criminal charges against him regarding my niece. Also, we are seeking visitation rights and sole/joint custody of my nephew who remains in the home. My niece is revealing signs of emotional abuse.

You will have to seek an answer regarding the criminal matter in the criminal section of , or contact the district attorney in your parish. With respect to custody, you did not say if the father had legal custody or not. Parental authority ends when the child reaches the age of 18 (Civil Code Article 216) .
