My husband was in an accident in my truch, but he is excluded from my insurance. The police report states it was not his fault.

The driver admitted he was driving in a two way turning lane and was cited. The person at fault insurance company is refusing to pay for the rental and states that they have to talk to 3 witnesses to determine liability when only 1 is listed on the police report. I have now learned that my truck is unrepairable and I can no longer afford to pay for the rental. The accident was on July 2nd and it is now the 15th. How long should this take to resolve.

Insurance companies don't have a set time that they must keep paying for a rental car for you. I assume your own insurance refuses to pay since husband was not on the policy. The other driver's insurance should settle the property damage claim within 30 days IF they determine that their driver was at fault. Most insurance companies drag their feet with that determination. I recommend hiring a lawyer to help you as you seem to be getting no where.

Since you did not have insurance, you are at the mercy of the other driver's insurance company. Does the insurance company have a copy of the police report? You should call the adjuster and ask if they have a copy of the police report. Is your husband injured? Since he did not have insurance, Proposition 213 applies. I would suggest retaining an attorney to help handle the damages. Feel free to contact my office for a free consultation. (818) 272-8882

I agree with my colleagues. You should retain an attorney and they will request a copy of the police report without having you or your husband provide a third party statement to the at fault driver's insurance company. This way you don't risk making any wrong moves that would hurt his case.

If your husband was hurt in a truck accident, make sure he gets proper medical help. Let him follow his physician's advise and request a free consult with a local auto, truck accident attorney. The attorney will know what to do and say to the insurance company. Best of luck.
