Can a witness file assault charges?
Anonymous2 views3 answers
It really isn't the victim or the witness who is pressing the charge, it is a determination made by the police. If they feel there is sufficient evidence to establish probable cause to arrest you, they may do so. That said, prosecuting the case will likely be difficult if the victim of the crime is not cooperative. You should contact a good defense attorney immediately to begin working on your defense. Good Luck.

It is not any one piece of evidence that the police need. They can collectively establish probable cause based on all available evidence, regardless of whether the victim is cooperative.
