My son was cut in a hotel pool with a sharp object (glass/metal). Is the hotel liable for pain and suffering?

The hotel did call the New Orleans EMS and they said that my son did not need stitches for the cut on his greater right toe. They offered a wheeled chair for my son. He remained on the wheeled chair for the rest of the trip. What can we do in this situation? My family and I took this vacation knowing that we would be walking a lot. Once my son got injured, our trip was pretty much ruined. My wife had to stay in the hotel while I took my three year old out. We were also deprived of enjoying the local food. We had to resort to room service. Our stay was from Tuesday to Friday. Wednesday was the day of the injury. Please help. Thank you for your time.

Just want to be clear, your son's toe was cut, did not need stitches, could not walk, he was confined to a hotel room for days. Truly sorry for what happened to your son and hope he is well, but an I missing something? Speak with local and qualified counsel. God luck.

Hypothetically speaking, say another hotel guest caused the broken glass to be in the pool a couple of minutes before your son cut his toe: how would that make your son's injury the hotel's fault? Under Texas law at least, it wouldn't. Sometimes bad things happen to nice people, including kids, and it is not anyone's legal fault. This may be one of those times. At a guess the hotel has signs up that say no glass in or around the swimming pool. Since it sounds like you're not even sure what cut your son's toe (glass, steel, or something else), it is going to be an uphill battle to prove a dangerous condition the hotel knew of and could have remedied injured your son.

Frustrating to lose very valuable vacation time. However I would not view this as a financially valuable case worth going through all the time lost and pain and suffering of litigation. However do check with local legal counsel. Best of luck to you and your family
