I am breaking a lease because of mold & mildew and water damage to the apartment from rain. They have not repaired the damage.

It has been a few months, since I have informed them of the damage. The Landlord wants me to pay for a relisting fee for breaking the lease. Do I have to pay the relisting fee if they have allowed me to break the lease ?

Thank you for your posting. The main question that needs to be addressed is, how did you inform the landlord or management of the issue and request repairs? To best protect yourself you should, or should have, sent the request via certified mail return receipt requested and waited at least seven days after receipt to look into your options. Your second best option is to call and report the issue to code compliance, their website is http://fortworthtexas.gov/codecompliance/ If you have not moved out having an attorney assist you in the move out can be very valuable and you can obtain assistance starting at a flat fee of $499. If you have already moved out your options are limited but an attorney can assist in negotiation the matter and possibly seek court determination of the matter and your obligations. You should be able to seek a free consultation with an attorney to go over your options.
