Ex trying to alienate me and allow girlfriend to be "mom", what can I do?
Anonymous4 views2 answers
My ex allows his girlfriend to go to all appointments with our daughter. He has sole custody. He does not inform me of these appointments or even tell me what happened at them or what is going on at them. I do not even know that they have happened unless I request medical records. He has his girlfriend listed as a parent constantly. An her opinion's are noted as a parent yet myself or my significant other are never allowed to attend these appointments. It seems like they are trying to have his girlfriend be mom and alienate me. What can I do about this?
Your rights depend on what standing you have in the existing custody orders. If he actually has SOLE legal and physical custody and you only have visitation, then you have no say and no standing. If you actually still maintain joint legal custody, then you do have a say and standing and would need to carefully document his violations, place him on notice in writing that you demand he recognize your rights, and then seek to have him held in contempt if he doesn't recognize your rights. Your best option is to have your existing court orders reviewed by an attorney in the jurisdiction where they were issued to determine what legal standing you have and what can be done to improve the situation.
Your court order regarding custody and parenting time must be reviewed to determine the circumstances currently. Generally, you should be informed of medical appointments and other activities and allowed to attend. It may be possible to seek language in a court order that requires that to occur but, as stated, a full review is necessary.
