Expungement Of Criminal Record 3 views 4 answers
Burglary conviction was 20 years ago. With the new laws being passed, would this now be available to be expunged? Thanks,

Burglary in the present criminal code is a Class 2 felony. I do not know what it was 20 years ago, nor do I know whether that would matter. As you know, it has long been the law in Illinois that no conviction, whether for felony or misdemeanor, could be expunged. Changes in the law at the beginning of this year, if I understand correctly, allow for expungement of certain Class 3 and Class 4 felonies where the petitioner can establish an honorable military record. Sex, gun and violent crimes are excluded. I would not think that the situation has changed for your burglary conviction, so I have to say that at first blush you would appear to be out of luck. You might want to set up a consultation to have an attorney review your case file and see if there is any way around it, but I cannot give you much hope. Of course, I may have missed something.

You also have the option of petitioning for executive clemency to allow your record to be expunged.

The new laws you may be referring to give you a better shake when filling out a job application. As of today, however, you cannot expunge a burglary conviction even though it happened 20 years ago.

You won't be able to expunge the burglary but you maybe eligible for some type of executive clemency such as sealing or a pardon.
