if i have a prior dacips that was a misd. and i just recently got another dacips in a different county and missed my court date what will most likely sentence being realistic
There are a number of variables that will affect the answer to this question, but you really should hire an attorney anyway. It's commonplace for prosecutors to ask for at least 30 days of jail time on a second DAC-IPS charge, especially when you just had one. If you hire an attorney who has a good relationship with the prosecutor for your jurisdiction, that will help. You will also be facing a probation violation on your previous DAC conviction most likely. Get an experienced defense attorney retained ASAP so you can get a plan in place to deal with all of it.
DAC-IPS is a gross misdemeanor but your prior may have been sentenced as a misdemeanor because the sentence was 90 days or less jail. So you face a probation violation (jail) on that case, and the new gross misdemeanor charge which is punishable up to 1 year in jail and $3,000 fine. With a prior DAC conviction, some prosecutors will want 30 to 60 days or more jail time, but it depends on the county, prosecutor, judge, etc., etc. But nobody knows how your case will end up that depends on the strength of your lawyer to a great extend, and cannot help you gauge the outcome.
If you missed court there is likely a warrant for your arrest. You should immediately retain an attorney to deal with that warrant as well as the new criminal case and the probation violation.
No one can predict outcome but jail time is in the realm of potential outcomes. I urge you to secure an experienced attorney so she/he may assist you with your issues. Tricia Dwyer Esq.
