Can I get off felony probation early in Illinois?
Anonymous4 views3 answers
I was convicted of aggravated domestic battery, a class 2 felony, in woodford county. I took a plea bargain which entailed 90 days in county jail, domestic violence classes, restitution, and 48 months of probation. I have completed my classes and payed my fees off. I have never failed a drop. I have been going to school since I've been out, which counts as employment for my probation conditions. Can I make a motion to get off probation early? As of march next year I will have completed 2 years of probation(half of it). Is it best to wait until I am half way through my probation time, or should I go ahead and file the motion now? Thanks in advance for the advice.
The closer to your termination date the more likely a judge will terminate your probation early. Also you better have a real good reason why you want/need early termination.
It is possible to be terminated early, and the fact that you have done everything that you were required to do would help. You do have to file a motion with the court requesting early termination, and the farther away your probation end date is, the less likely a judge would be to grant your motion, especially in Woodford County where the judges are more strict than in some neighboring counties.
First, you should consult with the original attorney who handled your specific case. While not familiar with the specific county or court, my personal experience has been that most courts want at LEAST half of any probationary period served without incident before they will consider early termination. If this was in the counties where I generally appear, I would suggest to you that you wait until you have at least half of your probationary period completed
