Am I eligible for asylum?

I have been to USA once and now I am back in China. I love the freedom and democracy in USA while in China I feel very repressed. If I post something about it online they can chase me and put me in trouble. I shared videos of Tianan men 1989 here and people got very mad. I feel unsafe in this country where I can't express my own feelings and words. They want everyone to shut their mouth. Also, I am gay. It's hard to be gay in a city where I am from. People discriminate against LGBT. I feel very hard to live here because I can't be myself as well. My question is, if I go to USA again, can I apply for asylum? How much would a lawyer charge for a case?

You may be eligible for asylum based on two grounds: political opinion and membership in a particular social group. You do, however, need to be in the United States in order to apply for asylum.

You can apply for asylum once you return to the U.S. However there is no guarantee that your asylum application will be approved. Speak to an immigration attorney privately for more details and for fees. Good luck!

If you intend to apply for asylum the proper path is to apply for refugee status overseas, as entering the US with a preconceived intent to apply for asylum here will be a major negative factor considered during the adjudication of your case.
