If you have not done any prison time on the prior DWI's you are looking at a third degree felony 2-10 years in TDC

You are looking at 2-10 years for a felony dwi however that range can be enhanced if you have prior felony convictions.

If they add the enhancement from the prior conviction your punishment range will be 2-20. Many Dallas judges lean toward treatment which is usually about 9 months in patient. Others will just give you one pen trip for both. Of course that's assuming you need to plea to the new case. Obviously you need to hire an experienced DWI attorney as soon as possible.

You have not told us your original sentence on the case for which you are on probation. If your probation is revoked, your sentence in that case cannot exceed the punishment that was assessed in the original sentence. If your new case is indicted as a DWI-3rd, the penalty range is from 2-10 years in the pen and a fine up to $10,000. You should be aware that the Judge has several different options with a new case and a probation revocation case before him or her at the same time without a plea bargain. You could be sent to prison on the new case and kept on probation on the old case (or vice-versa) so that you are still on probation when you parole on the new case. You need to hire an experienced criminal defense attorney to assist you with these two cases. There is too much at stake not to get the best attorney you can to advise you.
