Warrant in Debt - Medical Bill

Bankruptcy and Debt 4 views 2 answers
I received a Warrant in Debt (Civil Claim for Money) from an Anesthesia company for surgery I had earlier this year. I had health insurance during the time of the surgery however the insurance company and anesthesia company did not renew their contracts with one another and I was sent the bill. I have since been laid off from my job and no longer have health insurance nor the means to pay for this bill which has doubled because of attorney fees. My question is do I have to appear in court? And what options do I have to settle this bill?

I am not licensed in your state, however, the insurance not paying is typically not considered a valid defense to non payment of the bill. Inability to pay also is typically not a defense. If you ignore the case, a judgment will be entered against you allowing the creditor to take further action to collect on the debt. This can include garnishment of wages, garnishment of your bank account, liens on property, etc. It is a good idea to consult a local consumer law attorney as soon as possible to help you figure out how to deal with this case. The last thing you want to do is ignore it.

If you do not appear in court to answer this civil claim for damages, the court will likely enter a default judgment against you for the amount of the unpaid bill plus court costs and any attorney fees that may be applicable. You could contact the attorney for the plaintiff to determine whether any settlement might be worked out.
