Is it possible to get a DUI record removed?
Anonymous2 views2 answers
It was my first conviction; the offence happened in 2006 and by 2007 they closed the case. After some months they re-file the case and my lawyer ask me for additional $1000 in order to represent me “again”, and in this reopening of my case, I receive a full guilty DUI plea by the beginning of this year. I already complete everything including 100 community hours, 6 months of probation, and courses among others. I am about to finish my degree and I will be looking for a job with the next month so I really would like to know if something would be made.
Unfortunately, a DUI is one of the crimes that is NOT eligible for either a sealing or expungement in the State of Florida. The reason being that a DUI is an "enhanceable crime," meaning that your punishment depends on how many DUI's you have and in what period of time you have them. For example a second DUI within five years has a tougher punishment than a first DUI or a second DUI where your initial DUI was twenty years ago.
Florida's DUI laws require that a person convicted of the offense receive an adjudication. When this occurs, it makes you ineligible to have your DUI record sealed.
